Burning Rock Off-Road Park places the safety of trail users and the quality of experience of the trail system as top priorities. In order to maintain an acceptable standard of safety and an acceptable quality of experience for its visitors, Burning Rock Off-Road Park has determined that Vendors who provide tours and/or rent ATV’s or other vehicles for use on the trail system must meet a minimum standard of service.

Business’s not adhering to the vendor service regulations will lose their rights conduct any part of their business within the boundaries of Burning Rock Off-Road Park and will not be permitted to advertise on the Burning Rock Off Road Park web site.

In the instance of ATV Rentals and Tours, the provider must price this service at a level that will allow for the continued upkeep of vehicles and safety devices, as well as liability insurance, adequate payment of trained tour guides, training for tour guides, training for customers, trail passes for customers, outfitting gear for customers, adequate replacement equipment, emergency retrieval equipment, first aid equipment and training (of guides), general maintenance of transportation equipment, fuel, and the rental of a dedicated parking and take out area for the ATV rental vendor. While the various vendors need to be competitive, the competition should not be permitted to have a detrimental effect on the above mentioned items.

Burning Rock Off-Road Park has conducted interviews of the existing vendors who service the Hatfield McCoy Trail System and has established a price guide sheet for all certified vendors. All Certified Vendors are required to charge the minimum amount established by Burning Rock without any deductions for any circumstance. Other amenities such as lunches, camping fees, etc., must be added to the minimum price. Please refer to Exhibit One – Price List.

Only Certified ATV vendors will have access to the single-day and the seven-day permit that will be sold only to vendor’s guest. These permits will be issued in the form of wrist bands. Vendors wishing to provide guided rides must have their employees show the following qualifications:

ATV Safety Institute Training
CPR Certification
Knowledge of the trail system
Minimum of 18 years of age with a valid drivers license

Guide machines must be equipped with the following gear:

400cc
Winch
Wheel Chocks
50 Foot Tow Rope
1st Aid Kit
Fire Extinguisher
Radio Communication
GPS Locator

Guided tours will have a least 1 guide for each group of 8 people; if riders under 16 years of age are present, 2 guides will be required. Tours larger than eight will be required to have one guide for every six riders.

Each rental vehicle must be inspected and found in compliance with manufacturer’s recommendations every time prior to being rented for use. Inspection records must be made available at the trail head prior to each use. Each rental vehicle must be sized to fit the age group recommended by the manufacturer. A safety training program must be established to be given and completed by each of its customers. The program must meet minimum standards established by the ATV safety institute.

It is recommended but not required that individually rented ATV’s be equipped with a radio communication device.

Only Certified Vendors will have the opportunity to purchase a $20 permit on a single day and a $35 permit for multiple days up to seven. Certified Vendors will be permitted to have a designated parking and staging area for their business for an additional charge of $5 per vehicle rented. Vendor permits will be in the form of color coded wrist bands.

The application requires that the vendor have all of the training and inspection programs in place and pay a one time fee of $250.
